ALTERNATIVES TO WORKERS COMPENSATION FOR ACCIDENT CLAIMS

Raskin & Kremins, LLP Sept. 5, 2017

If you have been injured on the job, you may think that the only compensation you have coming is from your employer’s workers’ compensation insurance.  While this may be true in some instances, there are other situations in which you may be able to pursue a New York personal injury claim, including:

  • If a defective product caused your injury, you may be able to file a product liability claim against that product’s manufacturer;

  • If a toxic substance caused your injury, you may be able to file a toxic claim against the substance’s manufacturer;

  • If your injury was caused by a third party, you may be able to file a personal injury claim against them.

If your employer doesn’t have workers’ compensation insurance, you still may be able to sue for damages.  A New York personal injury attorney can help you understand what your rights are outside workers’ compensation – for example, to ensure you are properly compensated for temporary or permanent disability and pain and suffering.
